TERMS & CONDITIONS

This document sets out the general terms and conditions for the use of the website www.lonard.it, which offers the sale of watch products and accessories provided by the owner of the application.

1. Definitions

To ensure complete understanding and acceptance of these terms and conditions, the following terms, whether in singular or plural, shall have the meanings set out below:

Owner: Lonard S.r.l., with registered office at Via Luigi Capuana No. 9 – 09013 Carbonia SU, VAT Number / Tax Code 04094160928, CA – 362817, fully paid-up share capital of €500.00, certified email address lonard_watches@pec.it.Application: The website www.lonard.it.Products: The tangible products sold by the Owner.
User: Any person who accesses and uses the Application.
Consumer User: An individual of legal age who enters into a contract for purposes unrelated to their entrepreneurial, commercial, craft, or professional activity.
Content: Any textual or multimedia element present on the Application, including but not limited to advertisements, listings, reviews, images, etc.
Conditions: This contract, which governs the relationship between the Owner and Users and the sale of the Products offered by the Owner through the Application.

2. Scope of Application of the Conditions

The use of the Application implies acceptance of the Conditions by the User. If the User does not intend to accept the Conditions and/or any other notice, legal disclaimer, or policy published or referred to herein, they must not use the Application or its related services. The Conditions may be modified at any time. The applicable Conditions are those in force at the date of transmission of the purchase order or request for the supply of a Product.Before using the Application, the User must carefully read the Conditions and save or print them for future reference. The Owner reserves the right, at its discretion, to modify the graphical interface of the Application, its Content and organisation, as well as any other aspect relating to its functionality and management, informing Users where necessary.

3. Purchasing Through the Application

All Products offered through the Application are described in detail on their respective product pages (quality, characteristics, availability, price, delivery times and costs, additional charges, etc.). Minor discrepancies or errors between what is published on the Application and the actual Product may occur. Additionally, Product images are for representation purposes only and are not contractual elements.Purchases of one or more Products through the Application are permitted only for Consumer Users. Individual purchases are allowed only if the User is of legal age. Minors must have any purchase and/or request for Products reviewed and authorised by parents or legal guardians. The offer of Products through the Application constitutes an invitation to offer, and the order submitted by the User is a contractual purchase proposal, subject to acceptance as described below.The Owner has the absolute right to accept or reject the User's order without the User being able to raise any objections or claims. The sales contract for the Products is considered finalised only when the Owner accepts the User's purchase proposal. The Owner will accept the User’s proposal by sending an order confirmation email, which will include the order date, User details, Product characteristics and availability, price or pricing method, any additional charges and taxes, delivery address, estimated delivery time and cost, the right of withdrawal or its exclusion, and the warranty.If a Product is unavailable, the Owner will inform the User of new delivery terms and ask whether they wish to confirm their order. The contract will be considered finalised only for the Products accepted by the Owner. The User agrees to verify the correctness of the details in the order confirmation and to notify the Owner immediately of any errors. The User must keep a copy of their order, the relevant confirmation, and these Conditions.

4. Registration

To use the features of the Application, Users must register by providing truthful and complete information in the registration form and fully accept the Privacy Policy (https://www.lonard.it/privacy_policy/) and these Conditions.The User is responsible for safeguarding their login credentials, which must be used exclusively by them and must not be shared with third parties. The User must keep them confidential and ensure that no third party has access to them. If the User suspects or becomes aware of any unauthorised use or disclosure of their credentials, they must immediately notify the Owner.

5. Account Deletion and Closure

A registered User may stop using the Application at any time and deactivate their account or request its deletion via the Application interface, if possible, or by sending an email to info@lonard.it. In case of a breach of these Conditions or applicable laws, the Owner reserves the right to suspend or terminate the User's account at any time without notice.

6. Prices and Payments

Each Product price is displayed inclusive of VAT, where applicable. If it is not possible to calculate the price in advance, the pricing method will be indicated. Delivery charges and other potential costs vary depending on the destination, selected delivery method, and payment method. If these costs cannot be reasonably calculated in advance, the Application will specify which charges will apply.The Owner reserves the right to modify Product prices and any additional costs at any time, but such changes will not affect previously concluded contracts.The Application uses third-party payment processing services and does not store or process payment details (credit card numbers, account details, passwords, etc.). If these third parties deny payment authorisation, the Owner cannot provide the Products and will not be liable in any way.

7. Invoicing

Users who require an invoice must provide accurate billing details. The invoice will be issued based on the information provided, and the User guarantees the accuracy of these details.

8. Delivery of Physical Products

Physical Products (including any goods with digital elements) will be delivered to the address specified by the User using the method and within the time specified on the Application and order confirmation. If a Product is unavailable, the User will be notified via email and given the option to accept a revised delivery time or cancel the order for a refund. Upon receiving the Product, the User must verify its compliance with the order and the integrity of the packaging. If visible damage is found, the User may refuse delivery and return the Product at no cost. Once the delivery document is signed, the User cannot dispute the external characteristics of the delivered Products.

9. Consumer User Right of Withdrawal

Consumer Users have the right to withdraw from a purchase within 14 days of receiving the Product without penalties or the need for justification. Users must notify the Owner in writing at info@lonard.it before the withdrawal period expires.The User must return the Product without undue delay and no later than 14 days from the withdrawal notification. The User bears the direct return shipping cost unless the Owner agrees otherwise. Refunds will be processed within 14 days of notification, using the same payment method as the original transaction.The Product must be unused, in the same condition as received (including protective films), and returned in its original packaging with all accessories. If the Product is damaged due to misuse, negligence, or alteration, the Owner will not accept the return and will charge the User for reshipping.

10. Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to:

- Custom-made or personalised Products.
- Perishable Products, including food and beverages.
- Sealed items that cannot be returned for hygiene reasons if opened.
- Products that, after delivery, are inseparably mixed with other goods.

11. Privacy

Personal data processing is governed by the Privacy Policy, available at: Privacy Policy.

12. Applicable Law and Jurisdiction

These Conditions are subject to Italian law. Consumer Users may bring disputes to their place of residence or domicile in Italy or choose another competent court. European Consumer Users can also use the EU’s online dispute resolution platform: ec.europa.eu/consumers/odr/.
