Legal Warranty of Conformity

All products sold on the website www.lonardwatches.com are covered by the Legal Warranty of Conformity provided for in Articles 128–135 of the Italian Consumer Code (Legal Warranty).

The warranty regime for products sold by Lonard S.r.l. varies depending on whether the purchaser is a “consumer” or a “professional” under Directive 1999/44/EC concerning certain aspects of the sale of consumer goods and associated guarantees.

If you purchase as a “consumer,” you benefit from the legal warranty of conformity to which the seller is bound by law on every good sold (“Legal Warranty”).

The Legal Warranty – which applies to Lonard S.r.l. as the seller – protects the product against non-conformity with the sales contract.

Who it applies to

The Legal Warranty is reserved for consumers. It therefore applies only to users who have made a purchase on the website www.lonardwatches.com, during events organized by Lonard S.r.l. (direct sales), or through the network of authorized retailers, for purposes unrelated to any business, commercial, artisanal, or professional activity. Those who purchased through the website and do not qualify as consumers will be subject to the warranties for product defects, warranty for lack of promised or essential qualities, and other warranties provided by the Italian Civil Code, with the relevant terms, deadlines, and limitations.

When it applies

The seller is liable (for items purchased via the website) to the consumer for any lack of conformity that exists at the time of delivery and that becomes apparent within two years from the date of delivery. The defect must be reported to the seller, under penalty of forfeiture of the warranty, within two months from the date it was discovered.

The warranty is valid provided that the following conditions are met:
• the defect appears within 24 months from the delivery date of the product;
• the customer makes a formal complaint about the defect within a maximum of 2 months from the date it was discovered, unless this conflicts with mandatory overriding provisions of the customer’s country of habitual residence;

Unless proven otherwise, any non-conformity that becomes apparent within six months of delivery is presumed to have existed at the time of delivery, unless this presumption is incompatible with the nature of the product or the nature of the defect. From the seventh month onward, the consumer is responsible for proving that the defect already existed at the time of delivery.

To benefit from the Legal Warranty, it is necessary to provide proof of the purchase and delivery date. For this purpose, please retain the warranty card issued by Lonard S.r.l., which includes a unique 20-digit identification code, and possibly the purchase invoice or any other document proving the purchase date.

What is a conformity defect

A product has a conformity defect if:
• it is not suitable for the usual purpose of goods of the same type;
• it does not match the description made by the seller and does not possess the qualities of the product that the seller presented to the consumer as a sample or model;
• it does not have the qualities and performance normally found in goods of the same type, which the consumer can reasonably expect, considering also any public statements made in advertising or labeling;
• it is not fit for the particular purpose for which the consumer intended it and that was made known to the seller at the time of contract conclusion, and accepted by the seller.

Therefore, the Legal Warranty does not cover any faults or malfunctions caused by accidents or user liability, or from use that is inconsistent with the product’s intended purpose and/or with the technical documentation provided, if available, or with the product’s user instructions. Regarding watches, parts such as straps, cases, and crystals are not covered under warranty.

Please also note that while Lonard S.r.l. continuously adopts measures to ensure that product photos shown on the website are faithful reproductions of the original products – including using all possible technology to minimize inaccuracies – variations may occur due to technical limitations and color resolution settings of your device. Consequently, the seller is not liable for any inadequacy in the product images on the website if due to such technical limitations, as these images are for illustrative purposes only.

What to do in case of a conformity defect

If a conformity defect is reported within the terms, you are entitled to:
Primarily, repair or replacement of the product, free of charge, at your choice, unless the chosen remedy is objectively impossible or excessively burdensome compared to the alternative. In the specific case of this type of sale, considering the availability, replacement will be offered where possible based on remaining stock;
Secondarily (i.e., if repair or replacement is impossible, excessively burdensome, not completed within a reasonable time, or if previous attempts caused significant inconvenience), a reduction in price or cancellation of the contract, at your choice.

A remedy is considered excessively burdensome if it imposes unreasonable costs on the seller compared to alternative remedies, considering: (i) the value the item would have had if it were not defective; (ii) the extent of the defect; (iii) the possibility of using an alternative remedy without significant inconvenience to the consumer.

Refund or Reduction under the Legal Warranty

In case of contract cancellation, Lonard S.r.l. will refund the total amount paid. In case of a price reduction, Lonard S.r.l. will refund the agreed reduction amount.

The amount of the refund or reduction will be communicated via email and credited to the payment method you used.

Specifically, in the case of non-conformity, the consumer who has signed the contract will be entitled to restore product conformity free of charge, by repair or replacement, or to receive an appropriate price reduction, or to terminate the contract and receive a refund.

Exchange or Refund for Obvious Defects

Exchange or refund for a product with evident manufacturing defects is possible within 7 (seven) days of receiving the item. Beyond this period, if the item is eligible under the policies of the brand’s service centers, it may be repaired under warranty. Repair times under warranty vary by brand and can range from 45 to 60 working days.
